“Investigate With Sympathy, Sensitivity And Seriousness”, Court Gave Order In Death Case Of Youth In Police Custody

Advocate Rebecca John, on behalf of the petitioner, told the court that the government has shown complete insensitivity in this matter.

The High Court heard the case of death of a 32-year-old man allegedly in the custody of cops of Subhash Place police station. During this time, the court has directed to complete the magistrate investigation soon. A person named Sheikh Sahadat had allegedly died in police custody on July 23 last year. After which the family members of Sheikh Shahadat had filed a petition demanding registration of FIR against the accused policemen and formation of a special investigation team for investigation.

The investigation should be completed in three months

Justice Jyoti Singh said the trial court was not proceeding with the hearing of the case as a magisterial inquiry into the death was pending. He said that the investigation of this case should be completed as soon as possible and within three months.

Allegation of death due to beating

Advocate Rebecca John, on behalf of the petitioner, told the court that the government has shown complete insensitivity in this matter. There were black and blue marks of beating on the back and chest of the deceased. There was swelling on his hands and legs. Alleging beating, the family of the deceased had also recorded a video when they went to the mortuary.

The Justice then directed the concerned CMM to expedite the investigation. Also, the Director of FSL has been asked to submit the report without any delay. The court said that it is optimistic and hopes that the concerned magistrate handling the investigation will look at the case with sympathy, sensitivity and seriousness.
