Delhi High Court has given a big relief to GoFirst Airlines to give their planes on lease. The court has ordered to cancel the registration of all 54 aircraft related to the case. The court has ordered DGCA to cancel the registration of the planes within 5 working days. The court said that aircraft lessors can also export these aircraft as per the rules.
Go First’s resolution professionals have been barred from operating, accessing or flying aircraft. The court has also barred Go First’s resolution professionals from altering or removing any luggage, spare parts, documents or any other material from the aircraft. The resolution professional has been ordered to provide the lessors with the latest information and documents regarding the aircraft.
Justice Tara Vitasta Ganju rejected the resolution professional’s request to stay the proceedings of the order for a week so that he could file an appeal before a division bench of the court. As a result, the airline is at risk of losing all 54 of its aircraft if a resolution does not put a stop to the professional order. The court thus quashed the communication sent by the DGCA in May 2023, informing the lessors that their request for deregistration of the aircraft due to their entry into GoFirst was pending.
