The ongoing dispute between Rajya Sabha MP from Aam Aadmi Party and former chairperson of Delhi Women Commission, Swati Maliwal and Aam Aadmi Party doesn’t seem to end. Aam Aadmi Party has termed Swati Maliwal’s allegations as false after which Swati Maliwal has changed her profile on X.
Swati Maliwal has filed a case against Arvind Kejriwal’s personal secretary Vibhav Kumar under IPC sections 354, 506 and 509. After the allegations made by Maliwal, Delhi Police has recorded the statement under Section 164 before the Magistrate in Tis Hazari Court.
Delhi Police has arrested Vibhav Kumar. Now Vibhav Kumar has lost the option of filing anticipatory bail petition. According to Delhi High Court lawyer Amit Kumar, if Vibhav Kumar feels that allegations made in FIR are baseless or frivolous, then he can also approach court to cancel FIR against him under Section 482 of CrPC.
The court can quash FIR if it is convinced that there are no grounds for filing it. Under section 354 of IPC, the minimum punishment can be one year and the maximum can be five years with fine. The remaining sections have provisions for punishment ranging from one to two years.
According to Amit Kumar, the accused gets the benefit of delay in medical examination. If the police takes action on Vibhav Kumar’s complaint, then it is obvious that any decision will be taken only after allegations of both parties are confirmed in the investigation. Vibhav Kumar has also filed a complaint against Rajya Sabha MP Swati Maliwal under serious sections.
Vibhav Kumar has alleged in his complaint that Swati Maliwal is making false allegations against Kejriwal to put pressure on him. In his complaint, Vibhav has also said that Swati’s false allegations are spreading misunderstanding. Therefore, he is presenting the truth in front of everyone. After this complaint by Vibhav Kumar, the allegations made by Swati Maliwal become weak because Aam Aadmi Party has issued a statement terming allegations made by Maliwal as a conspiracy and false.
