In an important decision, the Allahabad High Court has directed the State Government and the Uttar Pradesh Bar Council to stop granting advocacy license to any person accused or convicted in a criminal case. The court commented, ‘It is an alarming situation that criminals are becoming lawyers.’
The above said order was passed by the Division Bench comprising of Mr Justice SD Singh and Mr Justice Vinod Diwakar on the petition of advocate Pawan Kumar Dubey
It was also held that the Bar Council should adopt the process of recording the details of the crime in the application itself, so that the practice license cannot be obtained by misleading others. The decision on the application should be taken only after the police report comes. At the same time, if the matter of hiding the facts comes to light, then it should be cancelled. .
According to the petition that despite of having a history of 14 criminal cases and being convicted in four cases, Jai Krishna Mishra of opposition Prayagraj was registered. After complaining about this, the High Court has given this order in view of the delay in taking the decision by the Bar Council.
The court has directed the disciplinary committee of the Bar Council to dispose of the petitioner’s complaint against opposition Jai Krishna Mishra within three months. It has been said that if such people continue to be given advocacy licenses, it will be harmful not only to the legal profession but also to the society. The court has given instructions to apply this process to all pending and filed applications.
