The petitioners have filed petitions in the Delhi High Court challenging the recent elections of the Patiala House Court Bar Association, Saket Court Bar Association, and Rouse Avenue Court Bar Association.
The petitions raise concerns over discrepancies in the elections and seek the court’s intervention.
Patiala House Court Bar Association Elections Dispute
The petitioners brought the issue regarding the Patiala House Court Bar Association election before the bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela for an immediate hearing.
The petitioners pointed out a contradiction between the number of registered voters and the number of votes cast.
They also claimed that they submitted a representation to the election officer, but the officer took no action.
The petitioners requested the court’s intervention to resolve the matter.
When the bench learned that the election results were declared on Sunday, it questioned the petitioner. The bench asked, “How can you challenge the election after the results have already been announced?”
The judges also inquired whether court intervention was justified at this point.
The petitioner argued that challenging the election was the only option left.
The bench observed that the Society Registration Act governs Bar Association elections, and it has its own set of procedures.
After some deliberation, the bench decided to list the case for further consideration.
Saket Court Bar Association Mismanagement Allegations
In another petition, the petitioners challenged the Saket Court Bar Association election over allegations of mismanagement.
The petitioners have asked the court to cancel the election and appoint a retired High Court judge as an observer to oversee the election process in the future.
A third petition was filed concerning the Rouse Avenue Court Bar Association election.
The petitioners informed the court that, while they were still counting the votes, they had already declared the results for certain posts the previous night.
The court has yet to take a final decision on the matter.
