Supreme Court Rejects Petition Challenging 3 New Laws Passed By Parliament

The Supreme Court has rejected the petition challenging the three new laws passed by the Parliament. This petition was filed on behalf of Supreme Court lawyer Vishal Tiwari. The court told the petitioner that we are not imposing fine on you. However, he requested the court to allow the petition to be withdrawn, after which the court rejected the petition and allowed it to be withdrawn.

It was said in the petition that the Indian Justice Code, Civil Defense Code and Indian Evidence Act passed by the Parliament should be examined by forming a committee under the chairmanship of a retired judge of the Supreme Court. The bench of Justice Bela M Trivedi and Justice Pankaj Mittal has rejected the petition. The plea wanted a stay on the implementation of new criminal laws.

It was alleged that these laws were not debated in Parliament and were passed because opposition MP’s were suspended. It was alleged in the petition that the new criminal laws are more stringent and this will establish police rule in the country. These laws violate the fundamental rights of the people of the country.

This law is more stringent than the English laws. In the old laws, there is a provision to keep a person in police custody for 15 days, but in the new laws this limit has been increased to 90 days. It is noteworthy that President Draupadi Murmu gave her assent to the three new criminal justice bills passed by the Parliament on 25 December 2023.

According to the notification, the laws will come into force from the date the Central Government issues a notification in the Official Gazette and different dates may be fixed for different provisions of this Code. Responding to the discussion on the three bills in Parliament, Union Home Minister Amit Shah had said that the emphasis of these bills is not on punishing like the previous laws, but on providing justice.

He had said that the purpose of these laws is to bring about a radical change in the criminal justice system in the country by defining various crimes and their punishment. In these, terrorism has been clearly defined, treason has been abolished as a crime and a new section titled Crimes against the State has been added. These bills were first introduced in the monsoon session of Parliament in August.
