High Court Orders Delhi Police To Give Tight Security To Transgender While File Nominations For Lok Sabha Elections

The High Court directed the Delhi Police to provide proper security to a transgender while filing nomination papers for the Lok Sabha elections. He said it is the duty of the state to protect and enforce the rights given to the transgender community under the Constitution.

Justice Anoop Kumar Mehdiratta, while saying this, asked the DCP (South) to provide proper security to the petitioner while filing nomination papers.

Petitioner Rajan Singh wants to file nomination from South Delhi parliamentary seat with the support of Rashtriya Bahujan Congress Party. He told the court that he was fatally attacked in his office in Badarpur earlier this month.

For this reason, he has requested for instructions to protect his fundamental rights and for proper security and has filed a petition. The judge said Article 14 of the Constitution ensures equality for all even in participation in the election process. Any discrimination based on sexual orientation or gender identity violates this provision.

He said Article 14 ensures equal protection of laws in all areas of state activity, including participation in the electoral process. It is the responsibility of the state to protect and implement the rights given to the transgender community under the Constitution. The Election Commission’s counsel had said that the nomination process had started on April 29 and the petitioner was free to file nomination as per law.
