Delhi Police has given a clean chit to Jagdish Kumar, who called AltNews founder Mohammad Zubair a ‘jihadi’. Delhi Police has told Delhi High Court that nothing objectionable has been found against Jagdish Kumar. In fact, Jagdish Kumar had said about Zubair that ‘a Jihadi always remains a Jihadi’.
According to the Bar & Bench report, Delhi Police told the court that it had interrogated Jagdish Kumar about his intentions and nothing incriminating was found in his statement. Delhi Police said that Jagdish Kumar’s tweet does not create fear or anxiety among the public. That is why no case has been registered against him.
The Delhi Police report presented in the court said, “The captioned tweets made by the complainant Shri Jagdish Singh and their investigation in this regard have revealed that the captioned tweets made on 18.04.2020 have caused any harm to the public or the public. There does not arise in any section any fear or anxiety which would induce any person to commit an offense against the State or against public peace. In view of the above, no case has been registered against the complainant i.e. Mr. Jagdish Singh in relation to the above tweet.”
In fact, in this case, the Delhi High Court had pulled up the Delhi Police for not taking action against Jagdish Kumar and registering an FIR against Zubair. After this, Delhi Police has presented its report in the court. This incident is of the year 2020. Zubair had called Jagdish Kumar a troll in his tweet and retweeted his display picture.
In his tweet, Mohammad Zubair had written, “Hello Jagdish Singh. Does your lovely granddaughter know about your part time job of abusing people on social media? I suggest you change your profile picture.” However, while retweeting Jagdish Kumar’s profile photo, Zubair had blurred the picture of his granddaughter.
After this, Delhi Police had registered a case against Zubair. The FIR lodged against Zubair for ‘threatening and harassing’ a minor girl on Twitter includes provisions of the Protection of Children from Sexual Harassment Act (POCSO) as well as sections of the Information Technology Act and the Indian Penal Code (IPC).
Delhi Police later filed an affidavit before the High Court saying that it had not named Zubair in the chargesheet as it did not find anything to make out any criminal case against Zubair. However, the Delhi High Court pulled up the police for failing to take action against Jagdish Kumar for allegedly making ‘hateful tweets’ against Zubair.
Justice Anup Jairam Bhambhani said the court would not be performing its duty if action was not taken against Jagdish Kumar for delivering hate speech against Zubair. The court had told Delhi Police, “You attacked him (Zubair) a lot, but the case has now ended as it should have because there was no evidence against him. But what action have you taken against this man (Jagdish Kumar)?”
