Delhi Court Acquits 11 people In Delhi Riot Case, 1 Charged Of Murder-Illegal Assembly

On the issue of acquittal of 11 people, Karkardooma Court’s Additional Sessions Judge Pulastya Pramachala said that their being part of the rioting mob at different times does not prove that they are responsible for Negi’s death.

The court has acquitted 11 people in the case of setting fire to several sweet shops and vandalizing houses in Gogulpuri police station area during the Delhi riots. But considering Mohammad Shahnawaz prima facie guilty in this case, it has framed charges against him for murder, rioting and illegal assembly.

Dilbar Negi, a 22-year-old waiter who worked at Anil Sweet Corner, was killed during the fire. FIR 39/2020 was registered in Gokulpuri police station regarding this. According to the statement of witnesses, during the riots, the rioters had also pelted stones at dharnas and shops and raised anti-Hindu slogans. They also entered a building during that time and killed Negi, who was hiding there. His body was burnt along with the building.

While framing charges against one person Shahnawaz, he said that there is evidence against him of being a part of the riotous mob and causing damage to the properties of Hindus. On this basis, charges are being framed against him under sections 148, 153A, 302, 436, 450, 149 and 188 of the IPC.

After the FIR was registered, the case was investigated by the local police and later further investigation was transferred to the Crime Branch’s SIT. 12 accused were arrested during the investigation. The charge sheet was filed against him on June 4, 2020.
