The Chhattisgarh High Court delivered a significant ruling in the Mahadev Online Book betting case by allowing the preservation of the value of frozen assets worth nearly ₹423.60 crore linked to the ongoing money laundering investigation.
The decision came in a matter involving multiple companies whose Demat accounts and securities were frozen by the Enforcement Directorate (ED) under the Prevention of Money Laundering Act (PMLA).
The petitioners argued that most of the attached assets consisted of listed equity shares that remained vulnerable to market fluctuations. They contended that prolonged freezing could erode the value of the securities and diminish the worth of the assets under attachment.
After examining the matter, the High Court approved a mechanism to preserve the value of the attached assets without compromising the objectives of the PMLA.
The court permitted the ED to consider liquidating the frozen shares and reinvesting the proceeds in safer and regulated financial instruments.
These instruments include SEBI-regulated mutual funds and debt-based products designed to protect capital during lengthy legal proceedings.
The ruling aims to ensure that the economic value of the attached assets remains intact while the investigation and judicial process continue.
The court emphasised that preserving the value of the assets serves the larger purpose of safeguarding potential proceeds of crime without exposing them to unnecessary market risks.
The judgment marks an important development in the Mahadev betting app probe and establishes a significant precedent for the management and protection of attached financial assets during money-laundering investigations.
