Justice BR Gavai Says Rights Are Meaningless Without A Dignified Life

Former Chief Justice BR Gavai said political freedom alone cannot fulfil human rights unless every person has access to food, healthcare, education and employment.

He made the remarks while addressing the 9th NC Chagla Memorial Lecture, which focused on the relationship between human rights and the United Nations Sustainable Development Goals (SDGs).

“Human rights are not limited to rights enshrined in legal provisions and the pages of the Constitution; they are directly linked to the social and economic conditions necessary for living a dignified life. Political freedom alone cannot be sufficient. Unless a citizen has access to basic necessities such as food, education, healthcare, employment and a life of dignity, the real benefits of their rights will remain limited.”

Justice Gavai paid tribute to Justice NC Chagla, recalling his contribution to law and public life.

He said Chagla’s life reflected a strong commitment to the Constitution, the rule of law, democracy and the protection of civil liberties. He added that Chagla’s judicial philosophy continues to guide the legal community.

Referring to Dr BR Ambedkar’s ideas, Justice Gavai said political democracy can remain strong only when supported by social and economic democracy. He stressed that economic inequality and social divisions can weaken the foundation of political equality.

Justice Gavai also traced the development of international human rights standards, referring to the 1945 United Nations Charter and the 1948 Universal Declaration of Human Rights.

He said the declaration established human dignity, equality and freedom as key principles and helped give greater recognition to economic, social and cultural rights alongside civil and political rights.

He further discussed the global evolution of sustainable development, citing the 1972 Stockholm Conference, the 1987 Brundtland Commission report, Our Common Future, and the 1992 Rio Earth Summit.

Justice Gavai said sustainable development requires meeting the needs of the present without compromising the rights and resources of future generations.

He emphasised that development should not be measured only by GDP growth but also by environmental protection, social equality and the preservation of human dignity.
