A Delhi court has directed bar bodies to take appropriate action after an incident in which a lawyer unnecessarily provoked a defense counsel during a hearing and tried to attack him. Metropolitan Magistrate Renu gave orders while hearing a case under the Domestic Violence Protection Act.
This matter belongs to the family court. The magistrate said in an order on April 22 that when the defendant’s lawyer was presenting his views in response to the arguments, the petitioner’s lawyer was unnecessarily provoking the defendant’s lawyer by interfering despite the court’s warning. The petitioner’s lawyer tried to attack the respondent’s lawyer and also pushed two co-lawyers. While adjourning the hearing, the Magistrate said that a copy of this order should also be sent to Rohini Court Bar Association and Bar Council of Delhi for appropriate action. The action report should be filed on the next day of hearing, August 22.
Explaining the procedure of lawyers’ bodies in such cases, Bar Council of Delhi vice-president Sanjeev Nasiyar said that the council will call both the parties and investigate. He said that we can take strict action in such cases. If a case of professional misconduct is proved against a lawyer, we can take strict action like suspending the license or registration. Bar Council of Delhi can also give a strict warning based on the facts of the case.
