The Delhi High Court has denied bail to Vibhav Kumar, who is accused of assaulting Aam Aadmi Party’s Rajya Sabha MP and former Delhi Women’s Commission President Swati Maliwal. The court raised concerns that Kumar’s status could be used to tamper with evidence and influence witnesses, as the investigation is still going on.
Vibhav Kumar’s lawyer argued that his arrest was illegal and violated Section 41 A of the Criminal Procedure Code, which requires written records on the basis of the arrest. The lawyer further claimed that the accused was not informed of the reasons for his arrest before being taken into custody.

The court rejected Kumar’s petition, stating that the reasons for his arrest were mentioned in the magistrate’s order on May 20. The prosecution argued that the charges against Kumar are serious and there is a possibility of him influencing witnesses if granted bail.
This is the third time Vibhav Kumar’s bail plea has been rejected, with previous rejections by the Tis Hazari Court on June 7 and another sessions court on May 27. Kumar is currently in police custody and has also demanded compensation for being “forcibly kept in custody.”
The incident allegedly took place on May 13 at the official residence of Chief Minister Arvind Kejriwal, and an FIR was registered on May 16 based on Swati Maliwal’s statement.
