Delhi HC Rejects PIL For Virtual Campaigning By Arrested Political Leaders

Ahead of the Lok Sabha Elections 2024, the Delhi High Court has dismissed a petition that sought permission for incarcerated political leaders to conduct virtual campaigning via video conferencing.

The court termed the petition as contrary to fundamental legal principles and a blatant attempt at malicious propaganda.

The petition, filed by final year law student Amarjeet Gupta, argued for the Election Commission to establish a mechanism ensuring the participation of arrested political figures in electoral campaigning via VC.

Additionally, it urged for immediate notification to the Election Commission regarding the arrest of any political leader or candidate.

However, the High Court, led by the acting Chief Justice, expressed strong disapproval of the petition.

The bench labeled it as audacious and in direct conflict with basic legal tenets.

The court emphasized its commitment to staying apolitical and underscored the misuse of legal proceedings for strategic purposes.

The judgment reflects the judiciary’s adherence to legal principles, exercising discretion to uphold the integrity of electoral processes.

The court emphasized the importance of preventing the exploitation of legal mechanisms for political purposes, reaffirming its commitment to impartiality.

However, the court did not favor the petitioner’s argument that political leaders were being unfairly deprived of their constitutional and legal rights during elections.

Despite the petitioner’s claim of filing an application, the court noted the lack of response, intensifying their concerns.

This ruling comes amidst heightened political tensions, particularly in light of the Model Code of Conduct announced by the Election Commission.

The arrest of prominent political figures, including Delhi CM Arvind Kejriwal has added to the contentious atmosphere surrounding electoral processes.

The Delhi High Court’s decision serves as a testament to the judiciary’s commitment to upholding legal sanctity and impartiality. It also safeguards the integrity of democratic processes against potential exploitation for political gains.
