In a recent development, the Rouse Avenue Court has directed Mandoli Jail officials to submit a report on the medical condition of Naresh Balian, a leader from the Aam Aadmi Party (AAP), who is currently detained under the Maharashtra Control of Organized Crime Act (MCOCA).
The special judge, Kaavari Baveja, has ordered the authorities to file this report by March 28.
Additionally, the court has extended Balian’s judicial custody until April 16, 2025.
Court’s Action On Balian’s Health Complaint
The court’s decision follows a complaint from Balian, who claimed that he was not being provided the necessary medication for anxiety.
Balian, in his plea, stated that he had been experiencing anxiety but was not receiving proper medical attention from the jail authorities.
His health complaint has now prompted the court to take immediate action and ensure that a report on his condition is provided.
The court’s move highlights the judicial system’s commitment to addressing concerns regarding detainees’ well-being while in custody.
Naresh Balian’s Arrest & Detention Case History
Naresh Balian, arrested on December 4, 2023, faced an initial denial of bail in an extortion case.
After the Delhi Police granted him bail in a separate extortion case on November 30, 2023, they re-arrested him under MCOCA for his alleged involvement in criminal activities.
His arrest followed an investigation into his alleged connections with gangster Kapil Sangwan.
Kapil Sangwan, a notorious gangster currently residing in the UK, has played a significant role in several major criminal cases, including the Nafe Singh murder in Haryana.
Authorities suspect Sangwan of masterminding the killings of BJP leader Surender Matiyala and wrestler Ballu Pehalwan.
According to the Delhi Police, Balian and Sangwan had been in communication in 2023, which led to the registration of an FIR in relation to their alleged criminal activities.
Court’s Ruling
This ruling has sparked interest in the intersection of law, politics, and criminal activities, especially in the context of Balian’s political affiliations and his alleged connections with organized crime.
It raises important questions regarding the influence of criminal networks within political circles and the implications for those involved.
The court’s ruling also underscores the legal accountability that individuals, irrespective of their political positions, must adhere to within the framework of the law.
As the case progresses, it remains to be seen how it will impact the political landscape and the judicial process in India, particularly concerning the application of laws like MCOCA.
The continued scrutiny of Balian’s health, his political connections, and his legal battles will undoubtedly remain a significant topic in the ongoing discussions surrounding law and order in the region.
