Legal Complications For Kejriwal & AAP Leaders Over 2019 Dwarka Incident

In 2019, former Delhi Chief Minister Arvind Kejriwal and other Aam Aadmi Party (AAP) leaders found themselves at the center of a legal controversy involving the alleged misuse of public funds for large poster holdings in Dwarka, a locality in Delhi.

The case has now gained renewed attention with the registration of an FIR by the Delhi Police, following a ruling by the Rouse Avenue Court.

The authorities have filed an FIR against Kejriwal, former AAP MLA Gulab Singh, and former councilor Nitika Sharma, accusing them of violating public property laws and misusing government resources for personal or political gain.

Court’s Ruling On The Case

Additional Chief Judicial Magistrate Neha Mittal, who presided over the case, ruled that the evidence suggested Kejriwal and the other accused could face charges for misusing public funds.

Based on this, the court accepted a petition filed under Section 156(3) of the Criminal Procedure Code (CrPC), which allows the police to register an FIR based on the grounds presented in the petition.

Following the court’s direction, the Dwarka South Police were ordered to investigate the matter further and take appropriate action.

This ruling is important because it signals that the legal process is now officially underway, and the authorities are taking the issue seriously.

It has raised the stakes for the accused, who now face legal scrutiny over their actions during the 2019 election campaign.

2019 Allegations & Case Progress

The controversy dates back to 2019 when authorities alleged that Kejriwal, along with Singh and Sharma, used public funds to put up large poster holdings across Delhi, especially in Dwarka.

The government reportedly funded these posters, raising concerns about the proper use of taxpayer money.

The original complaint, filed in 2019, accused the leaders of intentionally misappropriating public funds for their own political purposes.

The complaint sought the registration of an FIR against Kejriwal and the others for this alleged misuse.

The Metropolitan Magistrate initially dismissed the case by rejecting the complaint in September 2022.

However, a session court overturned the decision, citing the need for further examination.

The session court’s ruling sent the case back to the Magistrate Court, which then decided to reopen the investigation.

Future Developments & Court Hearing

The case is far from over. The Rouse Avenue Court will hold its next hearing on April 18, 2025, to determine whether the court will press additional charges against Kejriwal and the other accused.
