High Court Bar Associations Submit Memorandum To Collegium; Seek Explanation On Justice Varma’s Transfer

The Presidents of various High Court Bar Associations, including Allahabad, Gujarat, Madhya Pradesh, Karnataka, Kerala, and Awadh, met with the Supreme Court Collegium and submitted a memorandum regarding the transfer of Justice Yashwant Varma.

The Collegium has assured the members that it will carefully consider the matter.

During the meeting, the Collegium addressed the Bar Association leaders’ questions, specifically explaining the reasons behind Justice Varma’s transfer and why it had taken back his judicial work.

Supreme Court Collegium’s Explanation On Justice Varma’s Transfer

Anil Tiwari, the President of Allahabad High Court Bar Association, stated that the Collegium explained that it had transferred Justice Yashwant Varma due to certain technical reasons.

The Bar members were also informed by the Collegium that they would present a detailed explanation of the decision in a general meeting of the Bar.

Following this, the Allahabad High Court lawyers would discuss the issue of the ongoing strike and decide whether to continue it or not.

The lawyers at Allahabad High Court have been on strike for several days in protest against the transfer of Justice Verma.

The Bar will make the decision regarding the withdrawal of the strike after the general meeting, where the Collegium will present its explanation.

Debate Over Supreme Court Collegium’s Decision

Gujarat High Court Bar Association President Brajesh Trivedi noted that the Collegium members, when discussing the matter, pointed out the importance of following proper procedures.

He emphasized that in court, the parties present all documents before the court passes an order, but in this case, the Bar Associations appeared to ask for a decision without reviewing all relevant documents.

Supreme Court Bar Association President Informed About the Issue

In response to the ongoing protest, Anil Tiwari also met with Supreme Court Bar Association President and senior lawyer Kapil Sibal.

Tiwari requested Sibal to communicate the Allahabad High Court Bar’s stance to the Chief Justice of India (CJI).

The Supreme Court Collegium initiated an internal investigation into Justice Yashwant Varma’s conduct.

In meetings held on March 20 and March 24, the Collegium discussed the matter and decided to send a proposal for Justice Varma’s transfer back to Allahabad High Court.

The Allahabad High Court Bar Association continues to protest this decision, seeking a thorough review of the Collegium’s actions.
