The Delhi High Court has disposed of the petition challenging the elections of the Rohini Bar Association, directing the Election Tribunal to hear the matter.
Justice Mini Pushkarna clarified that the Election Tribunal would decide the case based on its merits. The High Court also emphasized that the election records should be securely maintained.
Delhi High Court Issues Directive
The High Court issued a directive to all parties involved, stating they should not seek unnecessary adjournments before the Election Tribunal. The court further instructed the Tribunal to make a decision on the matter promptly.
Earlier, the Delhi High Court had issued a notice to the Election Commissioner, Observer, and Presiding Officer, seeking their response on allegations that the New Delhi Bar Association elections were not free and fair.
The court noted that the result announced on March 21 would be subject to its final decision.
As part of the investigation, the court ordered the Presiding Officer to submit the video recording of the polling station and verification of voters to clarify the situation.
Ruckus At Polling Booths And Alleged Discrepancies
During the hearing, ON Sharma, speaking to Bharat Express News Channel, claimed that individuals attempted to enter polling booths without the required cards, causing a disturbance.
He reported that the ruckus lasted for over an hour, during which the scanning process failed, allowing unverified members to cast their votes.
Sharma also pointed to discrepancies in the number of votes cast.
Presiding Officer Defends Election Process
In response, the Presiding Officer stated that they followed proper procedures before voting and verified the voter cards.
He assured the court that he had kept the verified declaration forms in a sealed cover to ensure the integrity of the election process.
In addition to the Rohini Bar Association case, the High Court is also hearing petitions concerning the elections of the Saket Court Bar Association and the Rouse Association.
These cases are under scrutiny for similar concerns regarding fairness and transparency in the election processes.
