The Allahabad High Court has stayed the arrest of Pakistani national and teacher Shumaila Khan, who has been residing and teaching in India for several years. The court passed the order after reviewing her plea against an FIR lodged in January 2025.

A bench comprising Justice Siddharth Verma and Justice Abdul Shahid heard the petition filed by Shumaila Khan. The teacher has served at a primary school in Bareilly since 2015. In her plea, Khan requested the cancellation of the FIR, which alleges that she has been living illegally in India.
The court reviewed her arguments and stayed her arrest until the next hearing. It also ordered that the bench hear both the petition challenging the FIR and her earlier petition on the cancellation of her residence certificate together.
The court scheduled the next hearing for October 7, 2025.
Authorities allege that Shumaila Khan, a Pakistani citizen, secured her teaching position at a primary school in Madhopur village, Fatehganj block, Bareilly, using a forged residence certificate.
The FIR claims she has been residing in India illegally while working as an assistant teacher. Officials claim that she obtained her appointment through fraudulent documents and violated Indian immigration laws.

Khan told the court that she had already filed a petition challenging the cancellation of her residence certificate, which the court had heard earlier, and requested the court to consider both matters together for proper judicial review.
The High Court acknowledged her submission and agreed to hear both cases jointly, while staying her arrest until the upcoming hearing.
The High Court’s decision to stay Khan’s arrest ensures that she will not face detention until the court reviews both petitions comprehensively.
