Supreme Court To Decide If Sharia Law Will Be Applicable On Former Muslims Or Not

The country’s apex court is going to decide whether Sharia law will be applicable on former Muslims or not. The Supreme Court has issued a notice seeking reply on the petition filed by a woman from Kerala. There is a possibility that the remaining property may be taken over by the father’s brothers’ family in the future. The court will next hear this case in July. Describing this as an important issue, the Supreme Court asked the Attorney General to appoint a legal officer who would assist the Supreme Court.

This petition has been filed by Safia PM. Safia X is the general secretary of the Muslims of Kerala organization. Safia has said in the petition that those who have left the religion of Islam and want to come under the secular law of India instead of Shariat, they should be allowed to do so. During the hearing of the case, the petitioner’s lawyer said that the article of the Constitution gives people the fundamental right to practice their religion.

This article also gives the right that someone can be an atheist if he wants. Despite this, just because one is born in a family following a particular religion, one should not be forced to follow the personal laws of that religion. The lawyer also said that even if the petitioner and his father state in writing that he is not a Muslim, his property will still be his property.

Claim is made by relatives. The petitioner has said in his petition that due to the provisions of Shariat, his father cannot give him more than 1/3rd of his property even if he wants to. According to the petitioner, his Muslim father has not officially left the religion, so he is facing problems in protecting our rights. She wants that Sharia law should not be imposed on her, but there is no such provision in the law.

That is, there is a void on which only the judiciary can do anything. Even if he obtains a No Religion or No Caste certificate, he will not be entitled to inherit under the secular law of India.
