Prayagraj: Allahabad High Court has cancelled the life imprisonment sentence of the accused of raping a six-year-old girl. The court said the prosecution failed to prove the crime beyond doubt. The court said the medical examination did not confirm the rape. No injury or swelling was found in the private parts. The trial court ignored the evidence of the doctor. The accused is entitled to get the benefit of doubt.
This order has been given by the division bench of Justice Ashwani Kumar Mishra and Justice Dr. Gautam Chaudhary while approving the appeal filed against the sentence of Heera.
It is known that on 24 October 2002, Additional Sessions Judge Bulandshahr convicted the accused appellant of raping the girl and sentenced him to life imprisonment and a fine of one thousand rupees.
Which was challenged in the appeal. The complainant lodged an FIR that when he was out, his wife had also gone to the forest. The four-year-old girl was alone at home. When she came out to play, the accused took her to a wheat field. People came when she screamed. She was found unconscious and covered in blood.

The police got her medical examination done and recorded her statement. Taking cognizance of the charge sheet, a trial was conducted in the sessions court. Witness statements were recorded. And life imprisonment was awarded.
The High Court said that the prosecution failed to provide evidence of rape. The court acquitted her and ordered her release.
