On December 8, 2023, TMC chief Mahua Moitra was ejected from the Lok Sabha as a result of a report by the Ethics Committee regarding the allegations of "cash for query" made against her.
The Delhi High Court issued a notice to the Delhi Police and sought a reply on the petition seeking the cancellation of the FIR lodged by NCW chairperson Rekha Sharma against TMC MP Mahua Moitra. The court will hear the case next on November 6.
Justice Nina Bansal Krishna is hearing the case. During the hearing, senior advocate Indira Jai Singh, appearing for Mahua Moitra, stated that the Delhi Police has not yet provided her a copy of the FIR. Subsequently, the Delhi Police gave a copy of the FIR to Mahua Moitra in the court. Opposing Mahua Moitra’s petition, the Delhi Police argued that the petition is not admissible and should be dismissed. They stated that Moitra’s challenge includes the communication of the National Commission for Women with Lok Sabha Speaker Om Birla and the Delhi Police.
Moitra’s Tweet against Rekha Sharma
The Delhi Police registered an FIR against Moitra this month under Section 79 of the Indian Penal Code, which deals with words, gestures, or acts intended to insult the dignity of a woman. Following the implementation of three new criminal laws on July 1, the Delhi Police Special Cell registered the first FIR under BNS. Moitra had commented on a video posted on the social media platform X, in which NCW chairperson Rekha Sharma was seen visiting the spot after the stampede in Hathras, Uttar Pradesh, on July 4. Moitra later removed the post from X.
