Justice Subramaniam Prasad’s bench granted permission to provide temporary land for an office to AAP. The ruling, delivered by the Delhi High Court, emphasized that while AAP does not possess the right to claim office land on Deen Dayal Upadhyay Marg, it is entitled to office space like other political parties.
The Delhi High court’s decision underscores the need for the Central Government to consider allocating temporary office space to AAP. This is temporary until a permanent land is assigned for AAP’s office.
During the court proceedings, the Union Ministry of Housing and Urban Development revealed that it had previously offered AAP a permanent office space near Saket Court, which AAP did not acknowledge. Advocate Rahul Mehra, represented AAP. Mehra argued that until the party is allotted land for office construction, it is entitled to a temporary office.
Mehra even suggested that a minister from the AAP government is prepared to offer his residence on Deen Dayal Upadhyaya Marg for the party’s use.
AAP claimed that the central government is discriminating against them compared to other parties. However, the central government countered by saying that there was no available space. The government’s lawyer clarified that allocations must be made from the general pool, as there is no special provision for political parties.
The government further revealed that AAP had declined an offer for office space in 2014. That made it challenging to allocate a housing unit from the pool. Additionally, the central government emphasized that the unit on DDU Marg must be returned.
The court’s decision brings the spotlight on the ongoing tussle between AAP and the Central Government over office space allocation. The Court’s decision signals a potential resolution in the coming weeks.
