A federal appeals court struck down most of the Trump administration’s global reciprocal tariffs, ruling that President Donald Trump lacked the authority to impose them.
The court clarified that the 1977 International Emergency Economic Powers Act (IEEPA) did not grant the president unlimited powers to levy tariffs.
“The statute bestows significant authority on the President to act during a national emergency, but none of these actions explicitly include the power to impose tariffs, duties, or taxes,” the court stated.
The court delayed the implementation of its order until October 14, allowing the administration time to appeal to the Supreme Court.
US tariffs on steel and aluminium, enacted under a separate legal authority, remain unaffected.
The judges noted that the IEEPA does not mention tariffs or related terms and lacks procedural safeguards to limit the president’s authority.
The ruling emphasised that Trump could not use the law as a blanket tool to justify reciprocal tariffs.

Responding on Truth Social, Trump insisted, “ALL TARIFFS ARE STILL IN EFFECT!”
He warned that implementing the ruling would ‘literally destroy the United States of America’.
Trump also pledged to challenge the decision before the Supreme Court.
Taking to Truth Social, President Trump wrote, “Now, with the help of the United States Supreme Court, we will use them to the benefit of our Nation, and Make America Rich, Strong, and Powerful Again!”
Since returning to office in January, Trump has made tariffs a central tool in his trade strategy—pressuring countries to concede in negotiations or punishing those that refuse.
In May, the US Court of International Trade in New York had also ruled against Trump, finding that he exceeded his authority in imposing tariffs under similar circumstances.
