Rouse Avenue Court Orders Re-Investigation Into Delhi Riots Case Involving Kapil Mishra

Rouse Avenue Court has ordered the Delhi Police to conduct a re-investigation and register an FIR against Delhi Law Minister Kapil Mishra in connection with the 2020 Delhi riots.

Chief Metropolitan Magistrate Vaibhav Chaurasia, after reviewing the evidence presented by the Delhi Police, concluded that Mishra’s presence in the Kardam Puri area during the riots warranted further investigation.

The court found that a cognizable offence had occurred and must be probed further.

Petitioner Claims In Rouse Avenue Involvement Of BJP Leaders In Riot

Mohammad Ilyas, a resident of Yamuna Vihar, filed a petition requesting the registration of an FIR against Kapil Mishra, BJP MLA Mohan Singh Bisht, former BJP MLA Jagdish Pradhan, Satpal, and five others, prompting the re-investigation.

Ilyas claimed that on February 23, 2020, he saw Kapil Mishra and his associates blocking a road in Kardam Puri.

He further alleged that Mishra’s group damaged street vendors’ vehicles during the incident, with police officers from the North East district present at the scene.

Ilyas also alleged that Mishra threatened the protesters, demanding they vacate the area or face consequences.

Delhi Police Opposes Registration Of FIR

During the hearing, the Delhi Police opposed the petition to register an FIR, arguing that Mishra had no role in the 2020 riots.

Special Public Prosecutor Amit Prasad, representing the Delhi Police, stated that the police had already investigated Mishra’s involvement in the larger conspiracy behind the riots.

The police also emphasized that the case implicated key figures, including former JNU student leader Umar Khalid and other student activists, with charges under the Unlawful Activities (Prevention) Act.

Court’s Decision And Further Investigation

While the police argued that the conspiracy involved other individuals and planned actions, such as the ‘Chakka Jam’ protests, the court ruled that the matter required further examination.

The police investigation had also suggested that there were efforts to frame Kapil Mishra for the violence.

Following the court’s order, the Delhi Police is now required to reopen the case and investigate Mishra’s role in the 2020 riots.

Case Continues Amid Political Tensions

The case has drawn significant attention due to its political ramifications, with the involvement of high-profile BJP leaders and allegations of their role in inciting the violence.

The court has scheduled further proceedings in the case, signaling that the investigation into the events surrounding the 2020 Delhi riots is far from over.
