Rajasthan Government Challenges Bail Of Cow Smuggling Accused In Supreme Court

The Rajasthan government filed a petition in the Supreme Court, seeking to revoke the bail granted to Nazim Khan, accused of cow smuggling. In the petition, the state argues that the release of Khan, who faces multiple charges, undermines justice and seeks immediate cancellation of his bail.

Supreme Court Initially Granted Bail Amid State’s Absence

A Supreme Court bench, led by Justice Suryakant and Justice Ujjwal Bhuiyan, granted Khan bail after observing that the Rajasthan government lacked representation. According to the court, the state received notice of Khan’s bail hearing on October 8, but no lawyer or official appeared to argue against his release.

Observing the lack of opposition and indefinite delays in the trial, the court ordered Khan’s release, emphasizing that his continued custody lacked sufficient justification.

Conditions Imposed On Bail To Ensure Compliance

The court specified conditions for Khan’s bail, requiring him to post substantial bail bonds with two sureties approved by the trial court. Additionally, the court stated that if Khan is involved in similar offenses in the future, it would be treated as a misuse of bail privileges. These measures aimed to ensure his compliance with the trial process and discourage any further criminal conduct.

Case Background & State’s Push for Custody

The cow smuggling case dates back to February 2021, when authorities at Nadoti police station in Karauli district registered a case against Khan, recovering 26 cows from his possession. Khan reportedly absconded shortly after the incident and remained at large until his capture in April 2024.

The state’s petition to cancel his bail underscores its determination to hold Khan accountable, especially given his record of evading the law.
