Maulana Arshad Madani Welcomes Supreme Court’s Ruling On Bulldozer Actions; Slams Government’s Role

Maulana Arshad Madani, leader of the Jamiat Ulama-i-Hind, has hailed the Supreme Court’s strong remarks against the government’s use of bulldozers to demolish homes. He asserted that such actions violate human rights.

The Supreme Court on Wednesday issued strict guidelines to prevent the practice of ‘bulldozer justice’, where state governments demolish the properties of individuals accused of crimes.

The Court stressed that the executive branch cannot declare someone guilty or unilaterally order the demolition of an accused person’s property without adhering to due legal processes.

A bench comprising Justices BR Gavai and KV Vishwanathan ruled that demolitions could only take place after a minimum of 15 days’ notice to the property owner.

The Court further clarified that demolishing a person’s house is not a valid form of punishment and emphasized that only the judiciary has the authority to assess the legality of such actions.

Madani, who filed the petition challenging the unlawful demolitions, welcomed the decision, calling it a crucial step in curbing arbitrary government actions.

Additionally, he expressed hope that the Supreme Court’s ruling would protect citizens from unlawful bulldozer demolitions carried out by authorities.

The Supreme Court’s verdict places significant restrictions on such actions, reinforcing the principle that judicial oversight is essential to ensuring justice and upholding constitutional rights.
