Gyanvapi : High Court issues notice to Muslim side in Vaju Khana survey case

Opposition parties on a petition challenging the validity of the Varanasi District Court’s order refusing to conduct a scientific survey of the alleged Vaju Khana located in the Gyanvapi complex. The court has said that the issue is worth considering.

High Court  has been issued to the Anjuman Intezamia Masjid Committee and other opposition parties on a petition challenging the validity of the Varanasi District Court’s order refusing to conduct a scientific survey of the alleged Vaju Khana located in the Gyanvapi complex. The court has said that the issue is worth considering.

 The above said order was passed by  Mr Justice Rohit Ranjan Aggarwal , on the revision petition of Rakhi Singh. In the petition, a demand has been made to conduct a survey of the bathroom.

The Varanasi District Judge, in an order dated October 21, 2023, had refused to direct the survey of the Vujukhana area. A week ago, Justice Manish Kumar Nigam had recused himself from hearing the case. In the application filed in the court of Varanasi District Judge, it was said that in the case in question, survey of the Vujukhana (except ‘Shivalingam’) is necessary to ascertain the religious character of the property.

Justice Aggarwal said that ASI has already conducted the survey. The report has also been submitted. On this, Saurabh Tiwari said that it is necessary to do the same in Vujukhana area also to know the religious character.

The court also questioned that how can a survey be conducted when the Supreme Court has ordered to seal the area? Saurabh Tiwari said that this can be done. ASGI said that whatever the court orders will be done. The justice asked the status of the caveat. Saurabh Tiwari expressed ignorance.
