Delhi High Court Rejects Vibhav Kumar's Petition Challenging Arrest in Swati Maliwal Assault Case

The Delhi Police has filed a chargesheet in the Tis Hazari Court against Vibhav Kumar, accused of assaulting Aam Aadmi Party’s Rajya Sabha MP and former Delhi Women’s Commission Chairperson Swati Maliwal. The chargesheet was filed under six sections of the Indian Penal Code (IPC), including attempt to commit culpable homicide, obstructing the way, disrobing a woman, criminal threat to kill, destroying evidence, and using obscene language.

The Tis Hazari Court will hear the chargesheet on July 30 and has directed Delhi Police to produce Vibhav Kumar physically in court on the same day. Kumar has been in jail for two months, and his bail pleas have been rejected twice by the Tis Hazari Court and once by the Delhi High Court.

The chargesheet is based on evidence collected from over 100 people, including 50 accused, and includes statements from policemen, government employees, and AIIMS doctors who conducted Maliwal’s medical examination. The police claim to have sufficient evidence to prosecute Vibhav Kumar.

However, the incident occurred on May 13 at the Chief Minister’s residence, where Maliwal was allegedly attacked by Vibhav Kumar with kicks, punches, and slaps. A case was registered against Kumar on May 15, and the police later added the section of destruction of evidence to the case.
