New Delhi, August 3: The Delhi High Court upheld the lower court’s decision to accept the closure report in the rape case against BJP leader and former Union Minister Syed Shahnawaz Hussain. Justice Neena Bansal Krishna found that documentary and scientific evidence did not prove Hussain’s presence at the alleged incident site on the specified date.
Court Finds No Basis for Allegations
The possibility of the alleged crime being committed was zero stated Justice Krishna. The court supported the Additional Sessions Judge’s decision to accept the closure report. The case was filed by a woman accusing Hussain of rape and criminal intimidation. However, the Delhi Police, after completing the investigation. Filed a closure report, stating no case was made out.
Complainant’s Appeal Dismissed
The complainant filed a petition in the ACMM court opposing the closure report. The ACMM took cognizance of offences under Sections 376, 328, and 506 against Hussain and summoned him to face trial. The sessions court later set aside this order, prompting the complainant to challenge the closure report in the high court.
Court Validates Lack of Evidence
Dismissing the woman’s revision petition, Justice Krishna noted that evidence showed Hussain and the complainant never met on the day of the alleged incident. The woman claimed Hussain took her to a farmhouse, raped her, and threatened her with a video. The complaint, filed in 2018, led to the case being registered on court orders. Hussain challenged the magistrate court’s order in the High Court and the Supreme Court, but both refused to intervene.
