Delhi High Court Imposes Unique Condition To Cancel FIR, Will Have To Work On Traffic Signal For 30 Days

Delhi High Court: Decisions and punishment are often given in the court for breaking the law or committing a crime, but sometimes some decisions become a reason for discussions. A similar case was recently seen in the Delhi High Court, where in return for quashing the case of indecent assault on a woman, the court sentenced the accused to assist the police at traffic signals for 30 days.

In fact, on April 16, the Delhi High Court rejected the FIR registered against Vikas Bohat on the condition that he would assist the Delhi Traffic Police at traffic signals for 30 days.

Justice Naveen Chawla booked Vikas Bohat under sections 354 (outraging the modesty of a woman), 506 (criminal intimidation) and 509 (word, gesture or act intended to outrage the modesty of a woman) of the Indian Penal Code (IPC). Dismissing the FIR lodged against him, this order was passed that he will have to report to DCP Traffic to assist the traffic police at the concerned traffic signal.

According to the order, on completion of 30 days, DCP Traffic will issue a certificate to the petitioner, which the petitioner will file in the court within 2 months. If such certificate is not filed, the Registry will place the matter before the Court for further directions.

Vikas Bohat had approached the Delhi High Court demanding cancellation of the FIR registered against him. The court was told that the petitioner and the complainant have resolved their disputes by mutual consent and have reached a compromise.

The court examined the FIR and the agreement and quashed the FIR, provided that Vikas Bohat gives his services to the Delhi Traffic Police for one month. The Court said that in view of the fact that respondent no. 2 does not wish to pursue her complaint and also that a settlement has been reached between both the parties, we feel that no purpose would be served by continuing the proceedings of the present FIR. This will not be accomplished because it will create more bitterness between the two sides.
