The Allahabad High Court is set to deliver a crucial decision today at 2 PM on the longstanding dispute between the Shri Krishna Janmabhoomi and the Shahi Idgah Mosque in Mathura. This landmark ruling will address a total of 15 petitions related to the contentious issue.
The case, which capture significant attention from both Hindu and Muslim communities, involves the dispute over the land of the Shahi Idgah Mosque. The Hindu side argues that the mosque built on land belonging to the Katra Keshav Dev temple, which they claim is 13.37 acres of the temple’s property.

On June 6, after completing the hearings, the Allahabad High Court reserved its decision. The focus of today’s ruling will be on the application file by the Muslim side under Order 7 Rule 11 of the Civil Procedure Code (CPC), which challenges the maintainability of the civil suit.
The Shahi Idgah Mosque Committee and the Sunni Central Waqf Board had contested the suit’s viability under Order 7 Rule 11 of the CPC. This aspect of the case has been a point of contention, with the Muslim side seeking to have the suit dismissed.
Issue Of Maintainability
In December 2023, the Allahabad High Court had ordered the formation of an advocate commission to survey the Shahi Idgah Mosque complex, which is adjacent to the Shri Krishna Janmabhoomi temple. This order challenge by the Muslim side in the Supreme Court, which place a stay on January 17, 2024, on the formation of the commission. However, the Supreme Court permitted the Allahabad High Court to continue hearing the case, including the issue of maintainability.
Following the Supreme Court’s stay, the Hindu side requested a revenue survey in the matter. In May 2023, the Allahabad High Court had stayed the earlier order for an advocate commission and transferred all related cases from the Mathura Court to itself.
Today’s verdict, deliver by a single bench of Justice Mayank Kumar Jain in Court No. 71, closely watches as it could significantly impact the legal and historical landscape of the dispute.
