High Court Refuses Bail To Maulvi Accused Of Forcibly Converting Unsound Minor’s Religion

Prayagraj: Allahabad High Court recently refused to grant bail to the Maulvi of the mosque who is accused of forcibly keeping a mentally unsound minor boy in a ‘madrasa’ after luring him and converting him to Islam.

Justice Sameer Jain’s bench refused to grant relief to Maulvi and said that there are serious allegations against the accused. The alleged victim has also made allegations against him in his statement recorded under Section 161 of the CrPC.

The accused petitioner Maulvi Syed Shad alias Mohd. Shad was arrested on February 18 this year under Sections 504 and 506 of the IPC and Section 3/5(1) of the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act, 2021.

The accused had approached the court seeking bail in the case. The case against the petitioner Maulvi has been registered in Police Station – Naubasta, Kanpur Nagar. The counsel for the petitioner argued that he has been made an accused in the present case on the basis of false allegations. It was also argued that the alleged victim was mentally unsound and neither did he change his religion nor was he forced to do it.

The Government council  on the other hand opposed the bail prayer and submitted that the applicant is a Maulvi in ​​the Mosque who not only lured the mentally challenged minor son of the informant to convert his religion but also after luring him kept him in the ‘Madrasa’ and thereafter forcibly converted him.

In this background, considering that the petitioner is a Maulvi in ​​a mosque and has been accused of forcefully converting a mentally challenged minor, the Court refused to grant him bail considering the gravity of the allegations and the evidence presented.
