The Allahabad High Court has granted temporary relief to Dr. Bhola Singh, MP of Bulandshahr, Secunderabad MLA Laxmi Raj Singh, and businessman Himanshu Mittal, who are facing charges in a criminal case before a special court.
In a recent ruling, Justice Samit Gopal directed the complainant, Pawan Kumar, to respond to the petition within three weeks.
During this period, the court has prohibited any coercive measures against the petitioners.
The court has set the next hearing date for 22 October.
This order comes in response to a petition challenging the ongoing case, filed by Dr. Bhola Singh and his co-defendants.
The petitioners contest an FIR lodged against them in Anupshahr, Bulandshahr, which includes charges under Sections 147, 148, 152, 323, 353, 427, 506 of the Indian Penal Code and Section 3 of the Public Property Damage Prevention Act.
Following an initial police investigation and a subsequent final report, a magistrate ordered a re-investigation.
The police again filed a final report after the re-investigation.
However, the special court issued summons to the petitioners on 6 August 2024, in response to objections raised by the complainant.
Challenging these proceedings under Section 528 of the BNSS, the petitioners have sought the cancellation of the case.
The court has deemed the issue complex and has called for a detailed response from the opposing side.
