The Allahabad High Court denied an exemption request from the Additional Chief Secretary (Finance). He sought to skip court due to a program with the Chief Minister. The court stated that proceedings should not delay because of any constitutional officer’s schedule. However, it excused the official’s absence but warned of strict action if he does not follow court orders by the next hearing.
Justice Salil Kumar Rai ordered all concerned officials to comply by November 11. They must file a compliance affidavit or appear in person to frame charges. This order follows a contempt petition from Laxman Prasad Kushwaha regarding non-compliance with a previous court order.
The case involves over Rs 1.25 crore owed to the petitioner, including salary arrears and interest. The Director of Basic Education had not approved this payment. In September, the court instructed the Director of Basic Education and the Principal Secretaries of Basic Education and Finance to ensure payment by September 30, 2024.
The Principal Secretary (Basic Education) received exemption to attend another hearing. However, the court found that the Additional Chief Secretary (Finance) could not justify his absence for the Chief Minister’s event. The court emphasized the need for accountability from all officials involved.
