The Supreme Court has reserved its decision in the Byju’s insolvency case. Glass Trust Company LLC has challenged the National Company Law Appellate Tribunal (NCLAT) ruling in the Supreme Court. Currently, the court has stayed any meetings of the committee of creditors led by the Interim Resolution Professional (IRP). The court emphasized that no further meetings should occur until a decision is made, maintaining the status quo.

Background of the Case

The bench, headed by Chief Justice DY Chandrachud, heard arguments from all parties before reserving its decision. On August 14, the Supreme Court overturned the NCLAT’s prior decision and reinstated the insolvency process against Byju’s. On August 2, NCLAT had approved an agreement between Byju’s and the BCCI, halting the insolvency process under specific conditions. Byju’s committed to pay Rs 158 crore to the BCCI, with funds reportedly provided by Byju Ravindran’s brother. During the hearing, Solicitor General Tushar Mehta, representing the BCCI, opposed the petition against the NCLAT ruling, stating that staying the order would jeopardize the settlement with BCCI. The NCLAT had warned that failure to make payments by the stipulated deadlines could restart the bankruptcy process.
