A Delhi court has reserved its judgment on the bail application of businessman Samir Modi, who faces allegations of rape, cheating, and criminal intimidation.
Additional Sessions Judge Vipin Kharb conducted the hearing in-camera after both the prosecution and defence requested a closed-door session. The court will pronounce its decision on 25 September.
According to the First Information Report (FIR) filed on 10 September 2025, the complainant alleged that Samir Modi maintained a live-in relationship with her for several years under the false promise of marriage.
The woman stated that they met at a prominent gym in South Delhi and had been together for over seven years.
She accused Samir Modi of repeated rape, deception, and threats. The FIR includes charges under Section 376 (rape) and Section 506 (criminal intimidation) of the Indian Penal Code.
Arrest at the Airport
Authorities arrested Samir Modi at Indira Gandhi International Airport upon his return from London after they issued a Look Out Circular (LOC) against him.
Delhi Police acted on a court order following the registration of the FIR.
He was initially placed in police custody and later remanded to judicial custody until 6 October. Samir Modi is the younger brother of fugitive businessman Lalit Modi.
Samir Modi’s defence team challenged the legitimacy of the arrest, claiming that authorities issued the Look Out Circular just four days after filing the FIR, which they argued was an unusually hasty move.
They further alleged that the complainant had attempted to blackmail Samir Modi, demanding ₹50 crore.
Samir Modi supported his defence by alleging that the woman had attempted to extort and harass him, citing earlier complaints he had filed to that effect.
Prosecution Opposes Bail
Delhi Police strongly opposed the bail plea, urging the court to reject it on the grounds that the accused could influence the investigation or evade justice due to his financial clout and international connections.
The prosecution also pointed out that the case concerns serious charges, and the investigation is still underway.
With arguments concluded, the court will deliver its verdict on 25 September. The case has drawn attention due to the high-profile nature of the accused and the seriousness of the charges.
The court has affirmed its intent to proceed with zero tolerance, stating that all aspects of the matter will be thoroughly examined.
