On Friday, the Supreme Court overturned the termination of two women judges, Sarita Chaudhary and Aditi Kumar Sharma, by the Madhya Pradesh High Court and the State government.
A bench comprising Justices BV Nagarathna and N Kotiswar Singh ruled that their dismissal was both unlawful and arbitrary, citing positive performance reports from the High Court.
The court ordered their reinstatement and stressed the importance of handling cases involving women judicial officers with greater sensitivity.
The case stemmed from a suo motu proceeding initiated by the Supreme Court in January 2024 after the termination of six women judges in Madhya Pradesh.
In September 2024, four of them were reinstated following the court’s intervention.

During the proceedings, the Supreme Court noted that one of the dismissed judges had faced severe personal hardships during her probation, including contracting COVID-19 and suffering a miscarriage.
The court found that the adverse remarks in her Annual Confidential Report (ACR) failed to consider these challenges, calling for a more compassionate approach from the judiciary.
Highlighting the difficulties women in the judiciary face, the court underscored the emotional and physical toll of miscarriage, urging judicial authorities to exercise greater awareness and sensitivity in such matters.
