In a significant ruling on child assault case, the Allahabad High Court denied bail to an accused of attempt to rape a four-year-old girl in Moradabad.

Justice Shekhar Kumar Yadav delivered the verdict on Child Assault Case, emphasizing the severity of the crime and its violation of the victim’s and society’s fundamental rights.

On April 21, 2024, the young victim wandered away from her family to watch a street performance. Eyewitnesses reported that accused forcibly took her away. When the family searched for the girl, they found her unconscious and injured near a railway gate crossing. The accused allegedly fled the scene.

An FIR was registered six days later, on April 27, 2024.

Ahsan claimed innocence, alleging false implication and discrepancies in the victim’s statements. He also cited a delay in filing the FIR and pointed to a medical report showing no internal or external injuries.

The public prosecutor opposed bail, highlighting the heinous nature of the crime and Ahsan’s history of four prior criminal cases.

Justice Yadav rejected the bail plea, stating, “This crime is not only against the victim but also against society… Such incidents are increasing in the country, and it is the duty of the court to ensure justice is delivered.” The court directed the trial to be completed within one year.
