The Allahabad High Court has ruled in favor of the state government’s appeal to offer another chance for candidates who did not pass certain subjects in the DLED/BTC examination.
However, the court has declined to grant any stay on this decision.
The ruling was delivered by a division bench led by Chief Justice Arun Bhansali and Justice Vikas Budhiraja after considering the arguments presented by government counsel alongside advocates Jahnavi Singh and Kauntey Singh, who represent the affected students.
During the hearing, the advocates highlighted that a previous ruling by a single bench found it discriminatory not to allow all students included in the petition to retake their failed subjects.
Citing Article 14 of the Constitution, which mandates equal rights for all, the single bench had ordered the state government to provide another opportunity for the students while recognizing the legitimacy of the government’s circulars.

Despite this ruling, the advocates pointed out that the state government had not yet initiated any concrete measures to organize the examinations.
A contempt petition related to this issue is still pending in court.
The advocates raised concerns about the government’s inaction, emphasizing that students remain uncertain about their educational futures.
The High Court specified that this ruling will only affect the students involved in this particular case.
The Court’s ruling underscores the importance of equitable opportunities in education while also highlighting the necessity for timely action from the government to address the concerns of the affected students.
As the court has not issued a stay on its decision, it remains crucial for the government to expedite arrangements for the upcoming examinations, ensuring that students can confidently pursue their educational aspirations.
