Delhi HC Upholds Decision To Demolish Mosque And Madarssa In Sarai Kale Khan

The petition had challenged the decision of Delhi Police and DDA to demolish the mosque and madrasa on June 13.

Disposing of the petition of  Faizyab The Mosque and Madrasa, the Delhi High Court on Thursday ordered them to vacate a mosque and madrasa located at Hazrat Nizamuddin in Sarai Kale Khan within a month. The court quoted illegal construction as the reason for the order.

The caretaker of Faizyab mosque and madrasa assured the court that he would remove all the material from there within a month.

Justice Amit Sharma asked the local bodies to allow one month for the same before taking any action. Justice Sharma made it clear that no further time will be given for this. The said construction site was to be demolished on June 13.

With this Justice Amit Sharma dispossessed the petition of caretaker Faizyab. In the latest petition caretaker has challenged the decision of authorities to demolish the Mosque and Madarsa in court. The caretaker in the petition had said that the decision of demolition was illegal, arbitrary and unconstitutional. The petition had demanded a stay on it.

The lawyer on the behalf of caretaker demanded a time of one month after Justice Sharma refused to stay.

The caretaker will not ask for further time. The petitioner also sought permission to withdraw his petition. In view of the undertaking of the caretaker, the judge granted time and disposed of his petition.

The petition had challenged the decision of Delhi Police and DDA to demolish the mosque and madrasa on June 13. The mosque and madrasa are located in Bhelolpur Khadar, Sarai Kale Khan. Apart from this, the petitioner copies of the order, minutes of the meeting.  File noting with the decision to demolish the mosque and madrasa was also demanded. The court said that the said property is necessary for public purposes.
