The Allahabad High Court has ordered the Executive Engineer of the PWD Kumbh Mela to provide a personal affidavit regarding compensation for land allegedly taken without legal authority. The court has prohibited any demolition of constructions on the petitioner’s property and scheduled the next hearing for September 25. This ruling follows a petition by Abhishek Upadhyay and two other residents from Kotwa village in Phulpur tehsil, Prayagraj.
Advocate Kunjesh Dubey, representing the petitioners, argued that their land has been occupied for Kumbh Mela preparations without proper acquisition or compensation. The Executive Engineer claimed that the petitioner is registered as the landowner in the revenue records. However, the petitioners assert that the construction is being carried out forcibly.
Dispute Over Land Acquisition and Compensation
The petitioner’s lawyer highlighted that no road was registered during the last consolidation. They argued that the ongoing construction is unauthorized and has not received the petitioner’s consent. The widening of the road, deemed a kutcha road, has not been documented in official records. The court’s intervention aims to clarify the legal status of the land and ensure justice for the affected parties.
