Tahir Hussain Granted Custody Parole, Interim Bail Denied By Court

Former Aam Aadmi Party (AAP) councillor, Tahir Hussain, who is currently in jail facing charges of conspiracy in the Delhi riots case, has received partial relief from the Karkardooma Court. The court granted him custody parole under specific conditions but rejected his request for interim bail.

The Karkardooma Court allowed Hussain custody parole to file his nomination for the upcoming elections. The court instructed authorities to take Hussain for the nomination process on January 16 and, if needed, on January 17.

However, the court imposed several conditions, including a ban on using mobile phones or the internet during this time. Hussain is also prohibited from speaking to the media and can only communicate with those directly involved in the nomination process.

Delhi Police Opposes Interim Bail

Earlier, on January 14, the Delhi High Court had rejected Hussain’s request for interim bail. The Delhi Police opposed the bail, arguing that Hussain posed a threat to society. Additional Solicitor General (ASG) Chetan Sharma, representing the police, described Hussain as the mastermind behind the Delhi riots and a key figure in the UAPA case.

Sharma further stated that Hussain was responsible for the deaths of multiple individuals during the riots.

Hussain’s Petition For Interim Bail

Hussain had approached the court seeking interim bail from January 14 to February 9 to contest the assembly elections in Delhi’s Mustafabad constituency as a candidate of the All India Majlis-e-Ittehad-ul-Muslimeen (AIMIM). He sought permission to file his nomination papers, open a bank account, and campaign for the elections. His lawyer argued that, as AIMIM is a recognized political party, Hussain would need to file asset details and submit a proposal for his nomination. During the hearing, Justice Neena Bansal Krishna remarked that it is possible to file a nomination even from jail, further complicating the case for Hussain’s bail request.

The court’s decision to grant custody parole, though rejecting interim bail, has allowed Hussain limited freedom to participate in the election process under strict conditions.
