The Supreme Court has declined to entertain a petition challenging the appointment of Ashwini Kumar as the administrator of the Delhi Waqf Board. The court directed the petitioner, Jamir Ahmed Jumlana, to approach the Delhi High Court with his grievances.
The petition, filed by Jamir Ahmed Jumlana, accused Ashwini Kumar of usurping a public post without legal authority. Jumlana had sought a direction from the Supreme Court to prevent Kumar from assuming the role of the administrator at the Delhi Waqf Board. However, the Supreme Court dismissed the petition, advising the petitioner to raise the matter before the Delhi High Court instead.
Meanwhile, the Delhi High Court had previously dismissed a similar petition, labelling it as an abuse of the legal process. The court found no valid reason to revoke the appointment of Ashwini Kumar, a Delhi government official, to the post of administrator.
In addition, the High Court imposed a fine of Rs 10,000 on the petitioner, Yamin Ali, for filing the writ petition, and directed the fine to be deposited in the Armed Forces War Casualty Welfare Fund within four weeks.
With the SC also dismissing the petition, Jumlana now faces the option of seeking redressal in the Delhi High Court. The case has sparked attention, but with the legal process moving forward, the matter of Kumar’s appointment remains to be addressed by the High Court.
