The Allahabad High Court strongly criticised the 51-year delay in allotting land to the soldier’s widow. The soldier had attained martyrdom during the 1971 Indo-Pakistan War.
The court expressed deep concern over Smt Sudama’s distressing condition. She is the wife of the deceased soldier from Tiyari village in Zamania, Ghazipur.
Sudama informed the court that officials allotted her only 2.5 bighas of land instead of the promised 5 bighas.
She stated that she has been fighting for her rightful share since 1974. She approached the court after decades of unaddressed grievances and alleged negligence by authorities.
The division bench of Justices Atul Sridharan and Aneesh Kumar Gupta said the widow’s claims, if true, are shocking for the state and society.
The bench stressed that the case reflects a disturbing disregard for the sacrifice of a soldier who laid down his life for the nation.
The court observed that a martyr’s widow deserves dignity, respect, and swift justice.
Any delay in granting her entitlement reflects a failure of administrative responsibility. The judges said that the matter requires urgent action.
The court directed the State’s counsel to immediately obtain instructions and ensure that the petitioner’s claim is resolved at the earliest.
It emphasised that no further delay should occur in addressing the widow’s long-pending grievance.
The High Court also ordered officials to submit a compliance report by 8 December 2025. The next hearing will take place on the same date.
A total of seven respondents, including the Central and State Governments, are party to the case. The court said that each respondent must act responsibly and prioritise the matter.
The bench added that the issue is not just legal but moral. It reflects how society treats the families of soldiers who make the ultimate sacrifice.
The court reminded the authorities that every promise made to a martyr’s family is a promise made to the nation’s conscience.
With these directions, the court moved to ensure accountability and restore the dignity that the petitioner has sought for more than five decades.
