The Supreme Court canceled the bail granted to former Congress MLA Giriraj Singh Malinga by the Rajasthan High Court. Justices V Ramasubramanian and Arvind Kumar ordered Malinga to surrender within two weeks. The court kept his special leave petition pending and scheduled a hearing after four weeks.
Charges and Case Background
Police filed an FIR against Malinga on March 28, 2022, citing charges of assault, intimidation, and threats. The case also includes sections of the SC/ST (Prevention of Atrocities) Act. Malinga allegedly assaulted an assistant engineer, leading to his arrest in May 2022 by CID-CB. Five other accused were also arrested. The Rajasthan High Court granted Malinga bail on May 17, 2022, noting his judicial cooperation.
Concerns Over Giriraj Singh Malinga’s Actions Post-Bail
After his release, Malinga participated in a roadshow, where he reportedly made intimidating statements. This led the complainant to seek his bail cancellation, fearing he could influence public opinion and intimidate witnesses. Recently, Malinga left Congress, joined BJP, and ran in the 2023 Rajasthan Assembly elections, where he lost to BSP’s Jaswant Singh Gurjar.
