Satyendar Jain Challenges Court’s Rejection Of Defamation Case Against Bansuri Swaraj

AAP leader and former Delhi minister Satyendar Jain has filed a revision petition against a trial court’s decision rejecting his defamation complaint against BJP MP Bansuri Swaraj.

The Sessions Court at Rouse Avenue has scheduled the matter for consideration on 12 March.

The court has also summoned the trial court records, with the case set for further deliberation on the next hearing date.

Allegations Against Bansuri Swaraj

Advocate Rajat Bhardwaj has filed Jain’s petition.

Jain had earlier lodged a defamation complaint against Swaraj, alleging that she made defamatory remarks about him concerning an Enforcement Directorate (ED) raid.

However, on 20 February 2025, Additional Chief Judicial Magistrate (ACJM) Neha Mittal declined to take cognizance of the complaint.

The former minister claimed that in an 5 October 2023, television interview, Swaraj falsely alleged that Rs 3 crore in cash, 1.8 kg of gold, and 133 gold coins were seized from his residence during the ED raid.

Jain claimed that Swaraj made these statements to damage his reputation and gain political mileage.

He further accused Swaraj of calling him ‘corrupt’ and a ‘fraud’, arguing that such statements had tarnished his public image.

The complaint stated that these remarks had far-reaching personal and social consequences, affecting his standing as a politician, husband, father, and member of society.

Jain contended that the allegations had inflicted irreversible damage to his credibility, both in his political career and personal life.

The court had previously issued a pre-summoning notice to both Swaraj and the news channel involved in airing the remarks on 16 December 2024.

During a hearing on 13 January, Swaraj’s counsel, advocate Siddhesh Kotwal, dismissed the complaint as politically driven, arguing that Jain was using it for electoral gains.

Kotwal further asserted that the statements were based on publicly available material and court observations.

Jain remains on bail in the related case, which is still pending before the court.
