The Allahabad High Court has directed the Ghaziabad Marriage Registration Officer to appear personally before the court and produce records related to the registration of a minor girl’s marriage.
Justice Tej Pratap Tiwari passed the order while hearing a criminal appeal filed by Ashish alias Nitish Verma. During arguments on Verma’s plea seeking suspension of his sentence, his counsel referred to a marriage registration certificate.
The certificate states that Verma registered his marriage with the victim on February 4, 2019.
The trial court found the victim aged 16 years and 11 months on the date of the incident.
The High Court noted that the circumstances raised questions over the registration authority’s decision to register the marriage despite the victim’s minor status.
The court directed the concerned officer to bring all records showing how the authority verified the victim’s age before registering the marriage.
The officer must explain the circumstances that led to the registration despite the trial court’s finding.
The court further directed the Ghaziabad District Magistrate to ensure the officer’s personal appearance before the court.
The High Court ordered the immediate dispatch of its order to the District Magistrate.
The court directed officials to send another copy to the Registrar (Compliance) to ensure compliance with its directions.
The High Court will hear the matter next on October 9, 2026.
