Delhi High Court Orders Repair Of Decade-Old Flyover

The Delhi High Court has directed the Delhi government to repair a decade-old flyover near Nathu Colony Chowk within three months.

This ruling came after hearing a petition filed by BJP MLA Jitendra Mahajan, seeking the repair of defects in the flyover. Following the court’s instructions, the petition has now been disposed of.

Court Sets Deadline For Repairs

Acting Chief Justice Vibhu Bakhru, leading the bench, stated that there is no longer a reason for further hearings on the matter.

The court acknowledged that the relevant authorities had already initiated the process to repair or reconstruct the flyover. It instructed the Delhi government and its agencies to complete the necessary repairs within three months.

Background Of Petition

BJP MLA Jitendra Mahajan had filed a Public Interest Litigation (PIL) last year, urging the court to direct the Delhi government, along with its Public Works Department (PWD) and the Delhi Tourism and Transportation Development Corporation (DTTDC), to repair the flyover and reopen it for public use.

Mahajan’s lawyer noted that he had raised concerns about the flyover’s condition for the past eight years, including bringing it up in the Delhi Assembly, yet no action had been taken.

Delhi Government Responds With Action Plan

During the proceedings, a lawyer representing the Delhi government informed the court that the authorities had appointed an independent agency to inspect the flyover’s condition.

Additionally, a meeting had been held under the chairmanship of the Chief Minister to discuss the next steps. The government assured the court that, once the inspection report is received, repair work would begin promptly.

The government also clarified that Chief Minister Atishi is personally aware of the matter, and the inspection would be completed within three months, after which repairs would start.

Court’s Previous Remarks On Flyover Condition

In a previous hearing, the court had expressed its dissatisfaction with the flyover’s deteriorating condition, criticizing city officials for failing to address the issue despite the flyover being in a weak and dangerous state since 2021. The court had even suggested that central investigating agencies should look into the matter, implying that there might have been efforts to suppress corruption surrounding the flyover’s upkeep.

With the court’s recent directive, the Delhi government is now under pressure to complete the repairs of the Nathu Colony Chowk flyover within the stipulated three-month period.

The case highlights ongoing concerns about infrastructure maintenance and the importance of timely government intervention to ensure public safety.
