The High Court recently refused to suspend the sentence awarded to Kuldeep Sengar. Former Bharatiya Janata Party (BJP) MLA is behind bars in the custodial death of the Unnao rape victim’s father. Justice Swarn Kanta Sharma said that of the total 10 years sentence, Sengar has already served six years in jail. However, the judge further maintained that his sentence could not be suspended.
The judge said that when factors such as the gravity of the crime, nature of the crime, criminal history of the convict and the impact on public confidence in the judiciary are considered, Kuldeep Sengar is not entitled to suspension of sentence.
He said that the victim’s family is in danger and is provided security by the Central Reserve Police Force (CRPF). Keeping all this in mind and the decisions of the Supreme Court, this court is not in favour of a suspension of sentence. Sengar’s petition is dismissed.
In December 2019, Sengar was convicted of raping the minor victim as well as the custodial death of the victim’s father. He was sentenced to life imprisonment in the rape case.
Sengar was sent to jail for 10 years in the custodial death case. In the case, a minor was allegedly kidnapped and raped by Sengar between June 11 and June 20, 2017. She was then sold for Rs 60,000. She was then recovered by the Makhi police station. Then, as per Sengar’s instructions, police officials threatened the victim and forbade her from speaking out.
